Welcome to Keys Premier Concierge (referred to as "we," "our," "us," or "Company"). By accessing our website (keyspremierconcierge.com), booking an activity, rental, or transportation service, or interacting with our concierge platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please refrain from using our website and services.

1. Scope of Services & Independent Operator Disclaimers

• Concierge & Referral Role: Keys Premier Concierge acts as a local concierge, booking agent, and marketing platform connecting visitors with third-party activity operators, tour providers, equipment rental companies, and independent transportation drivers in the Key West area.
• Third-Party Vendors: Unless explicitly stated otherwise, activities, excursions, boat rentals, golf cart rentals, and transportation services booked through our platform are operated and provided by independent third-party vendors and contractors. We do not directly own, manage, or control these third-party operators.

2. Limitation of Liability & Release

• General Release: Keys Premier Concierge, its owners, employees, agents, and partners shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages, injury, loss, accident, delay, irregularity, or property damage arising out of or in connection with any tour, activity, rental, or transportation service provided by third-party vendors.
• Assumption of Risk: Participation in recreational activities, water sports, boat charters, golf cart rentals, and travel in Key West involves inherent risks, including physical injury, equipment failure, or weather-related disruptions. By booking through us, you knowingly and freely assume all such risks on behalf of yourself and any members of your party.

3. Cancellation, Modification, and Refund Policies

• Customer Cancellations: All bookings are subject to the specific cancellation policy of the underlying third-party vendor or tour operator. If a customer cancels a booking, refunds (if any) are issued strictly in accordance with the vendor's policy and may be subject to non-refundable processing fees or booking deposits.
• Vendor Cancellations, Weather Disruptions, & Force Majeure:
  • Independent vendors, boat captains, or tour operators retain the right to cancel, alter, or delay any trip, rental, or excursion due to inclement weather, mechanical issues, safety concerns, Coast Guard advisories, or other unforeseen circumstances.
  • Keys Premier Concierge bears zero financial liability for trips cancelled, rescheduled, or altered by third-party vendors or due to weather conditions. In the event of a vendor or weather cancellation, your remedy (refund, credit, or rescheduling) is governed entirely by the applicable third-party vendor's operating terms. We are not responsible for out-of-pocket expenses, lodging costs, travel disruptions, or secondary damages resulting from a cancelled excursion.

4. Payments, Credit Cards, & Billing

• Payment Processing: All credit card and electronic payments processed via our website, payment links, or integrated CRM checkout tools are handled securely through our third-party merchant processor (Stripe). By submitting payment information, you authorize us (or our payment processor) to charge your card for the total agreed amount, including applicable taxes, fees, and deposits.
• Authorization & Accuracy: You represent and warrant that you are authorized to use the designated payment method and that all registration and billing information provided is true, accurate, and complete.
• Chargebacks & Disputes: You agree to contact us directly to resolve any billing inquiries or transaction discrepancies before filing a formal chargeback with your financial institution. Initiating an invalid or fraudulent chargeback may result in the suspension of future booking privileges and potential legal recourse.

5. User Conduct & Website Use

• You agree to use our website and communication channels (including SMS, phone, and email) only for lawful, legitimate concierge and booking purposes.
• You agree not to transmit any malicious code, spam, automated scraping scripts, or fraudulent booking requests through our digital infrastructure.

6. Governing Law & Dispute Resolution

These Terms of Service and any disputes arising out of your use of our website or services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding related to these terms shall be brought exclusively in the state or federal courts located in Monroe County, Florida.

We reserve the right to modify, amend, or update these Terms of Service at any time without prior notice. The updated terms will be posted directly on our website with a revised effective date. Continued use of our services following any changes constitutes your binding acceptance of the updated terms.
